Mediation

Labor Mediation

Where people work together, conflicts can arise. When parties are unable to resolve matters on their own, labor mediation is an effective tool to restore dialogue and move the employment relationship forward.

Mediation in employment conflicts

Labor mediation can be used in cases of conflict or cooperation issues between employer and employee, or between colleagues.

It is often helpful to start mediation at an early stage — before problems escalate. Early intervention can avoid turmoil at the workplace, reduced productivity, and even absenteeism due to illness or stress.

Company doctors regularly recommend mediation, particularly when an employee is on sick leave due to tensions or conflict at work. In many cases, mediation can prevent the need for legal intervention or a prolonged legal battle.

Labor mediation may also address situations involving inappropriate behavior or integrity issues.

Oplossing arbeidsconflict

The success rate of labor mediation is high:

Around 90% of mediations lead to a resolution within just two or three sessions. The outcome is always based on choices made by the parties themselves. Typically, labor mediation results in one of the following three outcomes:

1. The employment relationship continues in its current form, with new work agreements in place
2. The employment relationship continues in a different form — for example, in another department or role
3. The employment relationship ends by mutual agreement, laid out in a settlement agreement

The goal of labor mediation is to establish clear agreements that allow everyone to move forward. All agreements reached are recorded in writing. This concludes the mediation process.
